Terms & conditions
The terms on which we provide the SMS-Patrol service. Written to be readable rather than impressive.
1. Who these terms are with
These terms are between you (the "Customer") and SMS-Patrol ("we", "us"), of West Wycombe Road, High Wycombe HP12 4AE, United Kingdom. By using the SMS-Patrol website, dashboard or mobile application (together, the "Service"), you agree to them.
2. The Service
SMS-Patrol is a cloud-hosted platform for guard tour management, security officer tracking, shift scheduling, incident reporting, timesheets and invoicing. It is provided on a subscription basis and accessed through a web browser and a mobile application.
We may improve, change or add features from time to time. We will not remove a material feature you rely on without giving reasonable notice.
3. Your account
- You are responsible for keeping login credentials secure and for activity carried out under your account.
- You must tell us promptly if you believe an account has been compromised.
- You are responsible for the accuracy of the information you enter.
- You must not share a single login between people who should have separate accounts — additional users are free, so there is no reason to.
4. Fees and payment
- Subscription fees are £60 per month for up to 40 guards and £100 per month for up to 100 guards. Accounts above 100 guards are priced separately by agreement.
- All prices are in pounds sterling and exclude VAT, which is charged where applicable.
- Fees are payable monthly in advance unless we have agreed annual billing.
- There is no setup fee and no minimum contract term.
- If your guard headcount exceeds your plan limit, we will move you to the appropriate plan and adjust your next invoice. We will tell you before we do.
- We may change our prices, but we will give at least 30 days' notice before a change affects you, and you may cancel if you do not accept it.
- If an invoice remains unpaid for 30 days we may suspend access after giving notice. Your data is retained during a suspension.
5. Cancellation
- You may cancel at any time by contacting us. Cancellation takes effect at the end of your current paid month.
- We do not refund part-months, but we do not charge you for the following month.
- Before you leave, you can export your data in PDF, Excel and CSV format. We will keep your data available for a reasonable period after cancellation to allow that, then delete it.
- We may terminate an account for serious breach of these terms, or for non-payment after notice.
6. Your data
- Your data belongs to you. We claim no ownership of the information you put into the Service.
- We process it in order to provide the Service, in accordance with our privacy policy.
- For personal data about your staff and clients, you are the data controller and we are the data processor.
- You are responsible for having a lawful basis for processing that data — including location data for your officers — and for informing your staff appropriately.
- You can export your data at any time during your subscription.
7. Acceptable use
You agree not to:
- Use the Service for anything unlawful, or to harass, monitor or surveil anyone unlawfully.
- Track individuals who are not your staff acting in the course of their employment, or track staff outside working time.
- Attempt to gain unauthorised access to the Service or to other customers' data.
- Reverse engineer, copy or resell the Service without our written agreement.
- Introduce malicious code, or place unreasonable load on the platform.
8. Availability and support
- We aim for high availability but do not guarantee uninterrupted service.
- Planned maintenance is carried out outside UK business hours wherever possible, with notice for anything significant.
- Support is provided by phone, email and WhatsApp, Monday to Friday, 9am to 6pm UK time, at no additional charge.
- The mobile application depends on the officer's device, operating system and mobile network, which are outside our control.
9. Third-party services and hardware
The Service relies on third-party infrastructure including cloud hosting, mobile app stores, mapping and email delivery. NFC tags and QR labels are standard items you buy from suppliers of your choosing; we do not supply them and give no warranty in respect of them.
10. Liability
SMS-Patrol is a management and record-keeping tool. It is not a security service, an alarm receiving centre, or a substitute for your own risk assessments, procedures and supervision. In particular, SOS and check-in features depend on device, network and your own response arrangements, and must not be relied on as the sole means of protecting a lone worker.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
- Subject to that, our total liability in any 12-month period is limited to the fees you paid us in that period.
- We are not liable for indirect or consequential loss, loss of profit, loss of contracts, or loss arising from theft, damage or incidents at sites you are responsible for guarding.
11. Intellectual property
The Service, its software, design and branding remain our property. You are granted a non-exclusive, non-transferable licence to use the Service for your business for the duration of your subscription.
12. Confidentiality
Each party will keep the other's confidential information confidential and use it only for the purposes of the Service. This does not apply to information that is public, independently developed, or required to be disclosed by law.
13. Changes to these terms
We may update these terms. Material changes will be notified by email at least 30 days in advance, and continuing to use the Service after that date means you accept them.
14. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
